Experience in International Trade Proceedings Abroad
Ms. Ning has represented 17 Chinese steel companies in responding to the Section 201 Investigation initiated by the U.S. International Trade Commission (ITC) against the imports of certain steel products from the countries including China. Ms. Ning has also represented three Chinese tire companies in responding to the antidumping investigation initiated by the Egyptian Ministry of Economy and Foreign Trade against the Chinese tires.
Ms. Ning has represented the Chinese government in the negotiation of OECD New Shipbuilding Agreement. Ms. Ning has also held kinds of lectures for the relevant agencies of MOFCOM on such topics as WTO Rules of Subsidies and Countervailing Measures and WTO DSB Proceedings.
Ms. Ning has represented MOFCOM as the third participant in a good number of WTO disputes, including the Large Civil Aircraft Subsidies dispute between EU and US(DS316/317), US-Soft Lumber CVD(21.5)(DS257), US-Certain EC Products CVD(21.5)(DS212), Korea-Vessels(DS301), US-DRAMS CVD(DS296) and EC-Vessels(DS273).
Experience in Antidumping Investigation in China
Ms. Ning has represented fifteen international clients from Canada, Russia, US, Germany, Japan, UK, Thailand and Taiwan, including giants in relevant industries, such as BASF, Sumitomo, UCC, BP, ADM, etc., in China’s antidumping cases against foreign imports ever since December 1997. During this practice, hard-earned experience has been accumulated.
In Silicon Steel case, our client got an antidumping duty rate at 6%, which, pursuant to its assessment, would not have any negative impact on its export business to China. In Cold-Rolled Stainless Steel case, our client got one of the lowest rates among Japanese respondents, which afford them a relative competitive advantage. In Acrylates case, since the investigating authorities were persuaded to terminate the investigation on the German product, no antidumping duty had eventually been levied on our client.
Experience in Foreign Investment & Antitrust
Having worked as lawyer for the following companies to invest in China and accumulating hard-earned experience in this field, Susan Ning particular leads an anti-monopoly practice group, actively participates in the drafting of the Chinese anti-monopoly legislation and has gained considerable influence and established a strong relationship with relevant governmental and judicial authorities. She has also successfully represented quite many foreign companies in the anti-unfair competition litigation and anti-monopoly review process relating to mergers and acquisitions in China.
