Update: Export Controls & ITARs and Dual & Third Party National Rules

On January 18, 2011, I co-chaired a panel discussion hosted at the Canadian Embassy in Washington entitled "Perspectives on the Revised ITAR Provisions on Dual and Third Country Nationals".  The American Bar Association, Section of International Law, Export Controls & Economic Sanctions Committee was a co-sponsor of the program.  See the following advertisement - http://www.abanet.org/intlaw/committees/RevisedITAR_Jan18_2011.html

There was a great line up of speakers, including:

  • Minister Rona Ambrose, Canada's Minister of Public Works and Government Services Canada (PWGSC)
  • Dr. Jennifer Stewart, Chairman Foreign Procurement Group
  • Charles (Chuck) Shotwell, Director, Office of Defense Trade Controls Policy, U.S. Department of State
  • Simona Wambera, Director, Canada's Controlled Goods Directorate, PWGSC

The speakers discussed the proposed ITAR amendments dealing with dual / third country nationals and the shift away from a nationality based risk assessment.  We are waiting for the Final Rule to be published in the Federal Register.
